1. Purchase Contract:

This web site is operated by DeliVita Ltd (“we”, “us” or “our”). All purchases made on this web site are governed by these Terms and Conditions at any time although the Terms and Conditions governing any given purchase will be those in effect at the date of your order. If you order goods after we have published the changes you will be bound by those changes. Accordingly, you should check prior to each order to ensure that you understand the precise terms and conditions applicable to your purchase. To assist you in determining whether the Terms and Conditions have changed since your most recent order we will display the date when these Terms and Conditions were most recently updated.

We will confirm acceptance of your order. This will occur either by message on the website immediately after you have confirmed your order, or by us sending an e-mail to the email address you have provided to us. We may do both, in which case the acceptance will occur on whichever arrives sooner of the web message and the email. At this point the purchase contract will be made and we will supply the goods to you in accordance with your order and these Terms and Conditions.

2. Placing an Order

By clicking ‘Place Order’ you are submitting an offer to purchase the products subject to our standard trading terms as laid out below. Please check your items on the order prior to submission.

Acceptance of your order is not a guarantee by us of the availability of the Products and all acceptances are the subject of availability of the Products. If the Products which you have ordered are not available, we shall inform you of this as soon as possible and advise you of lead times.

As a private consumer payment shall be made upon order placement, Payments for private consumers can be made in three instalments.

For trading partners and retailers this will be payment upon our agreed trading terms.

Late payments may be subject to interest at 3% above the Bank Of England’s base rate.

Ownership of the goods shall not pass to the purchaser until full payment has been made.

Your Data is handled in accordance with applicable data protection law.

3. Product Pricing:

delivita.co.uk make every effort to ensure that the pricing displayed on our website is correct.

However, if an error in the pricing of a product is found we reserve the right to either cancel your order or contact you to arrange payment of any extra sum due or refund any over-payment made by you (as applicable).

The processing of an order can be cancelled or corrected by us at anytime up to the shipment of that order and any related items.

We reserve the right to alter all product pricing without notice.

The title in any products ordered from us does not pass to you, the purchaser until we have received and processed a full valid payment, and that payment has been made into our own bank account and your order has been shipped from our warehouse.

4. Availability:

Although we endeavour to hold stock of all the items advertised for sale on our site this cannot be guaranteed so that by acknowledging receipt of your order we are not creating a binding contract to supply what you have ordered but which we do not have in stock. The content of the site is managed and therefore any products that are out of stock should not be visible.

In the event of unavailability for whatever reason, we will advise you of our position when we receive your order and we will await your subsequent instructions.

5. Accuracy of Information:

We attempt to be as accurate as possible when describing our products on the Website; however, to the extent permitted by applicable law, we do not warrant that the product descriptions, colours or other content available on the Website are accurate, complete, reliable, current, or error-free.

6. Appearance of Products

Whilst every effort is made to give true representation of colours and brightness, all our goods, different web browsers and screen quality will portray these in different lights and brightness’s, so may vary slightly to your perception.

Similarly with our printed matter, illustrations and any pictorial guides may vary in tone and therefore are an indication of the exact colour only.

7. Risk & Ownership Transfer

Ownership of the products purchased pass to the buyer following receipt of payment.

Damage Risk passes to the purchaser when:

  1. Once your goods are signed for At your choice of delivery points as stated on your order
  2. When we have agreed an incoterm this time and date will be the final decision as specified
  3. In general other than as stated above, risk will transfer to the purchaser once goods leave our premises

8. Account Registration:

8.3 You must inform us immediately of any changes to the information that you provided when registering by updating your personal details.

We reserve the right to refuse to process and order due to suspected fraud or unauthorised or illegal activity. If such is the case, we may reject your order of our customer service department may call you at the phone number you provided to confirm your order. We also reserve the right to cancel any accounts or refuse to ship to certain addresses due to suspected fraud or unauthorized or illegal activity. We reserve the right to cancel any order using any promotional code, at our sole discretion. If any order cancellation occurs you will be credited in full for the cancelled orders. We take these measures to protect our customers as well as ourselves from fraud or other unauthorized or illegal activity.
